Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Ember AI Builder, the Ember AI account dashboard, related APIs, and associated services (together, the “Service”). The Service is offered under the Ember AI brand (“Ember AI,” “we,” “us,” or “our”). By creating an account, connecting a website, or purchasing or using the Service, you agree to these Terms.

1. The Service

Ember AI Builder is a WordPress website-building assistant. It can generate page structures, suggest content and images, and modify selected WordPress blocks using artificial-intelligence services. The Service uses credits for supported actions. Features, credit costs, model providers, and availability may change as the Service develops.

AI-generated material may be incomplete, inaccurate, or unsuitable for your intended use. You are responsible for reviewing, editing, testing, and approving all output before publishing or relying on it, including checking accessibility, security, copyright, factual accuracy, and legal compliance.

2. Accounts and connected sites

You must provide an email address you are entitled to use and keep access to that address secure. You are responsible for activity performed through your account and connected WordPress sites. You may connect only sites that you own or are authorized to administer. You can revoke a connected site from the Ember AI dashboard.

You must not misuse the Service, attempt to bypass credit or security controls, interfere with other users, reverse engineer protected parts of the Service, use the Service unlawfully, or submit content you do not have the right to process.

3. Credit packs

Current credit-pack prices, included credits, and the amount due are displayed before purchase. Credit packs are one-time purchases; they do not renew automatically. Purchased credits are added after Freemius confirms payment and do not expire while your account remains in good standing. Credits are service-usage units, have no cash value, cannot be transferred between accounts, and cannot be redeemed for money or other stored value.

A page generation and a modification use the credit amounts shown in the Service at the time of the action. If a payment is refunded, reversed, or charged back, we may remove the credits associated with that purchase, as described in our Refund Policy.

4. Orders and payment

New orders are processed by Freemius as our Merchant of Record. Our historical order process was conducted by our online reseller Paddle.com. Paddle.com was the Merchant of Record for those orders and provides related customer-service and return handling. Historical orders remain governed by the terms and policies shown when they were placed.

Freemius processes checkout, payment details, taxes, receipts, and eligible refunds under the purchase terms shown at checkout. Ember AI does not receive or store your full payment-card details. The price and one-time purchase shown in Freemius Checkout control the order you authorize.

5. Your content

You retain your rights in the content and websites you submit. You grant Ember AI and its service providers a limited permission to host, transmit, process, and transform that content only as reasonably necessary to operate, secure, and improve the Service and fulfill your requests. You represent that you have the rights and permissions needed for this processing.

6. Ember AI materials

The Service, software, interface, branding, documentation, and underlying technology are owned by or licensed to Ember AI and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose.

7. Availability and changes

We work to keep the Service available, but do not guarantee uninterrupted or error-free operation. Maintenance, provider outages, security events, or changes to third-party services may affect availability. We may modify or discontinue features, and will provide reasonable notice when a material change adversely affects purchased credits where practicable.

8. Suspension and termination

We may restrict or suspend access when reasonably necessary to protect the Service, users, or third parties; investigate suspected misuse; comply with law; or address nonpayment. You may stop using the Service at any time. Provisions that by their nature should survive termination—including payment obligations, intellectual property, disclaimers, and limitations of liability—will survive.

9. Disclaimers and liability

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties that are not expressly stated in these Terms. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded. To the maximum extent permitted by law, Ember AI will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill arising from use of the Service.

10. Privacy and policy changes

Our Privacy Notice explains how we handle personal data. We may update these Terms to reflect changes in the Service, law, or business practices. The effective date above will be updated, and material changes will be communicated through the Service or by email when appropriate. Continued use after an update takes effect constitutes acceptance where permitted by law.
